Legal Question in Employment Law in California
Waitress concern
Working as a waitress you make minimum wage plus your tips. Now my question is if you work for a company that makes you pull your tips together and put them into a white envlope where at the end of 2 weeks those tips are to be divided amoung waitresses, waiters, hostestess, cooks and dish washers. Would it be wrong for the employer to say they are going to hold onto the tips themselves and divide them amoung everyone at the end of the 2 weeks according to the amount of hours each person has worked? I am curious only because how can you be certain that the employer will be honest about the amount of tips the waitresses have made? It would be very easy for the employer to lie and steal the tip money for themselves. What does the law say about this?

Re: Waitress concern
I would be careful about it, but there may be some things you can do. Do all waiters and waitresses want this, or just you alone?
