Legal Question in Employment Law in California
I was a waitress at Pizza Hut. As a waitress we are responsible for the customers who leave the restaurant without paying for what they ate. A customer was about to leave without paying and so I reprinted a receipt to give to her and asked "have you taken care of your ticket?" she got offended called me names and pushed me with both hands on my chest next thing I know, we were both in the floor exchanging punches and grabbing each other�s hair. She tried to bang my head against the floor, i was obviously resisting so now i got a neck injury i have to take care of and doctor recommended physical therapy. I immediately decide to quit the job afraid for my life being that the customer is a gang member of some sort. When i went to give my formal resignation letter, the store district manager was there and told me that if I hadn't quit that I would still have gotten terminated regardless, claiming that I was abusing a customer of his. Things need to change in that restaurant I dont think its fair and I wouldn�t want other servers going through what I went through. Do I have a case?
