Legal Question in Employment Law in California
I wanted to know if I can take legal action against my company. Late last year we got robbed at gunpoint and the thief took a lot of cash. We have cameras at our store but there is no recorder. My company did nothing to fix this issue as far as keeping employees safe. Just last night again we got robbed and the thief had one hand inside his jacket as if he had a gun and made us get on the ground. My company never installed a DVR or any sort of recording device to try to catch these thieves. The company I work for is not a small company and has over 3500 stores in the US alone. I am now scarred to go into stores alone and always fearful of getting robbed yet again. Most of our other stores have recording security surveillance and also emergency push buttons to notify police right away. I believe if we had these tools available we could have notified police immediately and also prevent this from happening again when people realize we got them on camera or try and get law enforcement on site asap. Can I sue my company for not keeping me safe and also not fixing the issue after it occurred once before?

Yes you can file a claim for worker's compensation benefits and it would be based on psychiatric effects of the robbery such as fear, anxiety and etc.. Feel free to call us at 213.388.7070 for a free consultation.
