Legal Question in Employment Law in California

My wife is pregnant. Recently at work she was given a review on her review. It says "keep in mind you will be missing 3 months of the first of year of the new employee because of pregnancy" . Also she has been written up because she sometimes during her lunch she spends an extra 10 minutes throwing up. To me this sounds like harrasment for being pregnant. What can she do? she works for a small company with 10 employees and no hr department she never even recieved company rules.

Hello.

Your wife should go to the doctor and see if there are any complications or medical conditions associated with your pregnancy that might entitle her by law to reasonable accommodations, modified duty or leave of absence.

The harassing conduct of the employer at this point is probably not severe enough to warrant legal action, but it might be a good idea to have an experienced labor attorney in your area contact that and inform them that your wife is represented and that someone is standing behind her, protecting her workplace rights.
