Legal Question in Employment Law in California
Will he be terminated?
My husband is a supervisor for a grocery store meat department. A woman who worked under him has been on stress leave for about 6 monthes or so. My husband had written her up for being late for work and making personal telephone calls while at work. She has now filed a suit against the store saying that he said ''Women don't belong in the meat department'' He says he never said this and feels like she's trying to punish him(and get money too). Does he have anything to stand on or is it Her word against his? Will he get fired?

Re: Will he be terminated?
If that's it, and he documented the write-ups, it's likely he and the market will prevail in the lawsuit. If she never complained to anyone else in the management hierarchy, then a jury would consider that, as well.
Your husband's longevity and whether there have been similar complaints will be considered in deciding whether to retain him. If he's a union member, he might talk with union lawyers and discuss the best way to protect his job. Good luck!
