Legal Question in Employment Law in California

I work for a bank based in Kansas City MO, and have been employed since March 2008. I was terminated on Friday the 11th of September. I am given 3 weeks of vacation at the beginning of each calendar year.

My question is upon termination they have told me I am not eligible for vacation payout.

Is that legal in California? I cannot find written answers so coming to you.

California law requires employers to pay all accrued vacation (that is vacation pay that has been earned) to an employee on the date of their termination. Whether your vacation pay accrued depends on the employers vacation policy. Ask for a copy of their written policy. If they have not followed it, you can file a wage claim with the California Labor Commissioner's office and also ask for waiting time penalties.
