Legal Question in Employment Law in California
I work for a big medical organization. We clock in using a time clock. The time clock only turns over every seven minutes, meaning if we clock in 6 minutes late it doesnt deduct from our time and if we clock out seven minutes late we do not get over time. The employer has taken to checking every time card and if we are even one minute late we face termination, but still dont get paid the overtime if we stay over past the clock. Can the employer enforce a termination for tardiness without paying the overtime at the end of the shift?
