Legal Question in Employment Law in California

work car accident

I worked 8 months under the table for a pool guy who has his own business. I drove one of his trucks for work and got into an accident. There was no paper work involved in regard to who would be liable for what if this occured. I ended up being at fault. My boss' insurance covered the other car's damages but not his trucks. My question is who is liable for the truck damages?

Re: work car accident

He is. Damages resulting from an on the job accident cannot be thrust upon an employee, unless it was the result of gross misconduct. If he tries to make you pay for the damages, he runs the risk of being exposed for several state and federal law violations by paying you off the books. The penalties could be quite severe.

Bottom line...if it was an accident, you don't have to pay for the damages tothe truck.
