Legal Question in Employment Law in California
I work for a government agency that overpaid me approximately $43K of overtime over a period of 18 months. It was automatically approved by the Timekeeper even though I never claimed overtime on my time card. An agency directive instructs supervisors to review the status of this pay upon leaving a unit, upon arriving to a new unit, and every January but this was never accomplished. Now the agency wants to "offset" (garnish) up to 15% of my net paycheck every two weeks until paid off. I can request a "waiver" from my agency, which I plan to do, but I have heard this is rarely approved. Is there any other way that I can fight this offset?
