Legal Question in Employment Law in California

Lets say i go to work on monday night and then i hit 8 hrs the next morning tuesday at 5am and i keep working past 5 am for some time. That time past 8 hrs should be overtime right because it was worked 8 hrs consecutively? Well if the company i work for restarts there day at 5am do they still have to give that overtime? Right now because of that restart time at 5am they clock everyone out and in at 5am so even if you started getting overtime at 4am until 5 am then at 5am till you clocked out would just be normal pay is this legal? this is consecutively worked hours without ever leaving work.
