Legal Question in Employment Law in California
Work place violence (l.A. Schools)
My mother in-law is a middle school physical education teacher in a rough part of the Los Angeles Unified School District. During one of her classes she was assaulted by one of the students, leaving visible damage to her face. The police were notified but that was it. To my knowledge, the school did nothing to improve the situation nor do they have proper security measures in place to protect teachers from attack. She has now decided to retire due to her fears and the lack of support from the administration to improve conditions. All of this after 30 years of dedication to the district. Is the school or student's parents liable at all for her being injured, and for not responding to this violence with proper action to further prevent such incidents? Does she have any kind of a case here? She loves teaching and it would be a big loss to teh district should she decide to retire earlier than planned on account of this and related subjects.

Your mother is entitled to worker's compensation for her physical and emotional injuries. Another attorney should jump in and respond to the liability of the school and parents.
