Legal Question in Employment Law in California

I work for a small business in California which has recently failed to pay its employees' regular paychecks.

We haven't been told we are "fired", and management is working to try to secure more investment and/or revenue. But this has been going on for weeks now. Our last "paycheck" didn't have taxes taken out of it, and at least one of these checks was returned for non-sufficient funds.

What recourse do we have? Can/should we file for unemployment while we hope our company gets its act together? (We like working here, and we'd rather not see the California labor board get involved unless as a last resort.)

Sorry, but your only real recourse is the Bureau of Labor Standards Enforcement of the Dept. of Industrial Relations (what you refer to as the labor board).
