Legal Question in Employment Law in California
I have worked for the same company over 20 years. We were once Emery Worldwide Airfreight but are now part of UPS.
Our contract has always started new hires at $2.00 below top scale with quarterly raises to reach top pay in 2 years. Nobody noticed a change to the pay for new hires including management in the new contract. 2 drivers have been hired recently and verbally told the pay would be as it was before at $2.00 below top. Todd has been working 4 months at the wage agreed to verbally and Lupe has been working 3 weeks. Both drivers have been informed of the new scale according to contract which is about $12 below top scale. They have been told their pay will be reduced and are liable for overpayment. About $12,000 in Todd's case. Plus Todd left a fulltime job based on the salary promised.

There is no actual question here, but, this seems like an issue for Todd and Lupe. Todd needs to go see an employment attorney, especially on the overpayment issue. If you are part of a union, this may be an issue to bring up to your union rep.
