Legal Question in Employment Law in California
I was working for a company for almost four years and the company foreclosed. I was not paid for the last pay period that I worked, nor where my co workers. The day I was let go I requested my pay and the owner did not have an answer. It has been several weeks and have not heard from him. I filed with the labor board. In the meantime I am aware that the owner of the company that foreclosed is still operating his other two business and retained one of the employees. If he has money to continue to operate his two businesses and retain one of the employees, I assume he has money to pay me for my last payroll plus my vacation time I was not paid for. Aside from the labor board paperwork that is still in process can I proceed with taking him to small claims court to obtain my pending wages, vacation and any other money I am entitled too?

You can use the labor board or file a lawsuit, but once you start one of these, you should not start the other. I'd stick with the labor board (Cal. DLSE). It's easier for you.
