I have been employed as a 9-1-1 dispatcher since 1985, by the county. I have been on workman's comp since July,1997 (4 yrs ago. A fellow co-worker, a dispatcher, came into the dispatch center with a gun. she threaten suicide ect.... Since then workman's comp has sent me to a therapist 2 times a week, my family psychiatrist and a psychiatrist bi-weekly. in March I saw a QME, who agreed with my dr's and suggested I be re-evaluated in 8 months. Today I received a letter from the workman's comp. attorney, asking me to schedule an appointment with them to provide a deposition. I yet to contact a lawyer. Should I now obtain my own attorney? Also I read that if the if the insurance company files documents and request a hearing with the appeals board that they then must pay my attorneys fee. Will they have to pay for my attorney now that there attorney has asked to interview me? on top of the letter I received the subject was: ME vs County of XXXXX ..... any information or options you can give me on my case would be greatly appreciated. thanks.

Yes attorney's fees for the deposition will be paid by the insurance company. You also have a statute of limitations coming up. You need to have an application for adjudication filed within 5 years. I have seen the value of worker's compensation claims increase by 10 times the amount after I have been hired by the worker. The worker's compensation system is very adversial. The insurance companies will get away with anything they can. They will pay you the minimum on your claim unless you obtain representation to protect your interests. The worker's compensation insurance companies have attorneys, why don't you? Attorney fees are limited by law to 9% to 12% of the final settlement or award. Call me directly at (619) 222-3504.
