Legal Question in Employment Law in California
Workplace Discrimination and Verbal Contracts
After my 90day probationary period, I told my boss about my HIV and cancer. She quickly offered to take me off payroll and put me on contract basis ''so I could keep my current insurance.'' The contract had a clause stating at the end of the contract period she could opt not to renew with no reason given. She began calling me a problem child, semiplayfully, but tinged with distaste. The workplace became hostile towards me. She ignored communications and refused to do my 3 month and 6 month review. I gave 30days notice in writing. Because she thought it was health related, she said to me and the Board I could have my job back no questions (thinking I wouldn't?). I accepted, she accepted in front of the staff. Two days later she said I'd have to reapply for my position and has been making me go through a series of writing excercises, stating legal necessity. She also is stating IF she accepts me back I'll have to go on 90day probation again. Help!
