Wrongful Termination

I was contracted by a marine towing co. in Calif. where I lived on the vessel for 6 weeks prior to being drug tested and joining the Union. After I returned from my 3 month sailing, I was notified by the USCG that my Master license was up for revocation due to failing the drug test. After a very arduous 2 years, my case was ''dismissed'' by the USCG and my license reinstated. Despite my having contacted the towing co. to reinstate my position, they never replied or responded to my request. Since I was exonerated of all charges and the testing facility was found to be in error for several reasons, is the company obligated to re-hire me and pay back salary?

Did you file a grievance with the Union? If not, you probably have no claim. If you did file a grievance, you must determine the status of the grievance. The Union should represent you in this matter and advise you of your options.
