Legal Question in Employment Law in California

Was this wrongful termination?

I've been working at a public state university for 2 years. I worked two departments of the school's vet school. I was hired at 25% time. I was supposed to sub for a girl in the morning shift (3-7am), but wanted the day off for a midterm that day. I called everyone I could, but no one would cover. So I called in sick. I was also working 7 days a week in the other dept, so wasn't supposed to work that many hours. I went to work today, and was told I was fired, immediately. For calling in sick! There were only two people left on the shift to work instead of 5, but this has been a problem for a while. I was terminated for leaving only two people on the shift. Was this legal? Is immediate firing legal? Are they allowed to fire me for calling in sick, when I already had too many hours, and only called in sick once? Can I file an official complaint about my boss for this?

Re: Was this wrongful termination?

You may have a case and should consult with a lawyer as there are many questions to be answered in determioning your rights. You can certainly complain to your boss's boss if you want to lodge a complaint against the boss. Immediate firings are legal in many circumstances so long as you are paid what you are owed immediately. Again, there are alot of questions that any lawyer will need answers to. Feel free to contact me with any questions and good luck to you. Martin
