Wrongful Termination/On the job accident

On 11/12/99 I was involved in an accident at work

and feel it was negligence on the part of the

employer as the vehicle we were in was overloaded

with heavy rocks and dirt. We told the foreman

that the vehicle was unstable, however we were

instructed to drive it anyway. The tie rods broke

and the truck veered into a tree at 25 miles per

hour. The business owner is attempting to claim

liability from employees insurance. They have only

asked driver about accident and have not asked me

( passenger) about accident. Since the accident I

have ear problems and slight hearing loss, as well

as lower back problems. On 11/19/99 the foreman

laid me off saying they were downsizing. Who is

liable for this accident? If I need to see a

physician, what should I do? Isn't the

employers insurance responible for reimbursement

to anyone injured since it was an incident that

was on t

It does not matter who is at fault. You were injured on the job so you are entitled to recover under worker's comp. regardless of who was at fault. go to the phone book and find an attorney who does workers comp.
