Legal Question in Employment Law in California

Wrongfull termination

I was terminated because a third party had a personality conflict with me and purposely set things up (lies, calls to my employer daily, ect...). I was called in my my supervisor one day out of the blue and told I was terminated effective immediately. I was not allowed to pick up my personal belongings and had to call for transportation home (50 miles away). I asked the reason for this happening and was given 3 differant reasons, all pitiful. At the same time I was told by my employer that they did not want to do this but the client had requested it. Then I was asked to write a resignation letter and if I did they would not fight unemployment. I did not resign, I was set up and I feel discriminated against and told to make it look like I resigned. Is the legal?

Re: Wrongfull termination

The chances are that you will not be able to sue the employer, if they fired you due to a customer complaint.

However, if you can prove that the third party did lie about you to your employer to get you fired, you may be able to sue the third party for damages.

Re: Wrongfull termination

you may be terminated as an at will employee for cause or no cause, but not for bad cause. what were the reasons you were told you were terminated exactly, and what do you feel the real reasons were that your employer is covering up?

Re: Wrongfull termination

-The bottom line in cases like this is what do you believe was the real reason for your termination. If it was because racial, sex, age or other group characteristic or for a reason against public policy such as whistle-blowing AND you can prove it, you have a case. If it was for purely personal reasons, i.e. didn't get along with the boss, you are likely stopped. Call me at 805/641-6600 if want to discuss further.
