3-day notice
When I first signed my agreement there is a one time payment of $1015.00, because a pro-rated rent due 2/1/08 which I paid as stated. My monthly rent is $1050.00. Now they posted in my door a 3 day notice. And if I decide to pay the $35.00 dlls. difference now it will be Total $85.00, because a late fee of $50.00--name removed--
My question is What can I do? I was not my fault, that they signed a paper saying about the pro-rated rent. and now I owed because of their mistake a late fee.

Pay the $85, and write a certified letter concerning the refund and unfair fee (late fees are illegal in California, though judges rarely throw them out, if they are in the lease).
Don't pay the money, and wait for this cheapo landlord to file an eviction, and defend yourself in court, telling your story to the judge.
