Legal Question in Landlord & Tenant Law in California

3 day notice

When I first signed my agreement there is a one time payment of $1015.00, because a pro-rated rent due 2/1/08 which I paid as stated. My monthly rent is $1050.00. Now they posted in my door a 3 day notice. And if I decide to pay the $35.00 dlls. difference now it will be Total $85.00, because a late fee of $50.00--name removed--

My question is What can I do? I was not my fault, that they signed a paper saying about the pro-rated rent. and now I owed because of their mistake a late fee.

You can refuse to pay, and then fight it out in small claims, or fight an eviction.

You can pay and then you file in small claims.

You can retain an attorney to write cheapo landlord a nasty letter, and then sue. If you retain an attorney for a trial, the loser is liable for court costs and attorney fees (not always ordered by the Judge).
