Legal Question in Landlord & Tenant Law in California

3 day notice

A three day notice was given on the 13th but was dated for the 12th. Rent was paid in full including late fees and NSF fees just a few hours after the dead line...if the managers take the money/check/money order from my hands is that acceptance of payment? Can they try to kick us out?

Re: 3 day notice

You would have to pay the full amount by the end of the third day -after- the date it was served upon you despite the date on the notice. Thus, if it were served on September 13, you would have had to pay by the end of the day on September 16. If they accepted the money, then you should be okay.
