60 day notice to vacate
my roommates and i rented an apt for a lease starting mid august 2007-july 15th 2008 in san diego. in the month of july08 we got served a 60 day notice to vacate with less than 30 days on our lease to go meaning we had to vacate by the 31st aug08, but also in order to move out we had to give them a 30 day notice if it was before that time period, which forced us to stay on a mtm basis for 1 more month because of the short notice. do we have any rights here?

No.
You are missing an "either or" provision in the lease.
If either the tenant or the landlord gives notice, the lease is over.
