Probably not.

But is it worth the risk of waiting? Even if the judge throws it out, an amended one will be filed, so you have saved a few days.

If you lose, you will still be thrown out in the street on the morning of Day 6.

The writ of execution is the last and final part of the eviction. My advice: move before Day 6.
