Legal Question in Landlord & Tenant Law in California

2 days ago, an unknown male tenant from my apartment complex hired a private towing company to tow my car from my carport that was assigned to me by the management over 5 months ago. The apartment complex is very much involved in finding out who did this and they are going to reimburse me for the towing expenses. What recourse do I have with this man if any? He believes that the parking spot is his for whatever reason but he has not gone to the management office to resolve this issue. I am scared that his behavior will escalate and he will hurt me or my car in some other way.

File a small claims court case against the tow company for the tow charges and for loss of use of your car which is the reasonable rental value for the time it was gone from your assigned parking spot. The tow company can then in turn make a claim against the unknown male who requested the vehicle be towed. The tow company must know his identity because they will not tow vehicles unless the requesting party signs and identifies themselves. Good luck .
