3rd party water bill

I live in an apartment complex that seems to do things as slimy as possible. When I signed my most recent lease, they added a water/trash fee. They send their water bill to some ageny in Texas (NW&P) and then the agency bills each of us tenants a set amount regardless of how much water we use. Is this legal? My NW&P bill is past due and the apartment complex says I am in violation of my lease because of this.

Read your new lease. What does it say about how much you are to pay for water and trash? Depending on its language, it might be fair to divide water use among the apartment's units. It would be more fair to take into account the number of bedrooms in each unit and pro-rate it based upon that criteria.
