Legal Question in Landlord & Tenant Law in California

apartment rental

I have been living in my apartment in Los Angeles for over 12 years. The landlord has recently put wood floors in the apartment below me. The new people who moved in below stay up until about 2:00 a.m. every day. Because of the wooden floors, when they walk, my whole apartment shakes. When they shut their door or cabinets, it sounds like a bomb going off. I can hear every word they say and tell you what tv show they're watching. I live in a rent controlled area and if I were to move from my home, it would cost me nearly double. Is there anything I can do? Is the landlord required to do something so that I don't have to stay up until 2:00 a.m. every morning listening to these people walk and shut doors? I have to get up at 6:30 a.m. and the fact that I get so little sleep is killing me. I know that I have a right to Quiet Enjoyment, but does that include hearing people walking or talking downstairs?

I agree that the covenant of quiet enjoyment is being compromised. Why not sit down with the landlord and see if you can come to a reasonable solution, especially perhaps carpeting in their bedroom. Invite the landlord over at night to hear the problem, etc. Acrimony won't get you anywhere, I'm sure. Good luck!
