Legal Question in Landlord & Tenant Law in California
appeal small claims case
I recently went to smaill claims court. My former Landlord sued me 7 months after I had moved out.I moved less than 1/2 mile away,1 week after I moved the landlord stopped by and asked me where the knobs were to the oven, I told her and that was the last time I saw or heard from them. When we moved the landlord was such a nightmare full of years of threats to raise the rent, harassment, that we just had it,he always said you will never get a dime of your deposit back, I cleaned the house, patched the nail holes, basic cleaning, and knew they would eat up my dep.
I never received an itemized list of exactly how they spent my deposit of 1500.00 and the Judge didn't forward any information(list, receipts, etc. over for me either when asked to view in court and still have yet to look at this list,The Judge failed to acknowledge that the plaintiff(landlord)only entered 1000.00 in deposits instead of 1500.00 in this claim
The judge did not hear a thing I said, after bringing key points to his attention, I feel that I was not given a fair hearing, in fact all the cases I heard that day were awarded to the plantiff or he sent them over to superior court. I need help on this, I want to see the receipts etc.do I have a good case.
thanks

Re: appeal small claims case
You can appeal the case to the superior court. IN the meantime, you can demand ''discovery'' from the plaintiff. That's when you get to view his receipts.
