Legal Question in Landlord & Tenant Law in California

Can I still argue an implied lease agreement of quiet enjoyment (in Ca.) if I don't comply with a 3 day notice to perform covenant or quit stating I need to pay late fees on rent? I am trying to move from a property that has drug dealers right behind me that I have been complaining to the landlord about for 9 months. I have also been reporting to the narcotics unit and police for loud parties. I got behind in my rent 6 months ago and have been making pmts but I now need the money to move.

You can raise it as a defense to having to pay as much rent as agreed to, but it may not be believeable if you have stayed there for 9 months. See if you can work out some deal with the landlord as to your leaving.
