Bad Check

After moving out I received my security deposit back,($2,000) minus $200.00. Nothing was in writting why he kept $200.00. Then his check bounced. Now he is sending me another check. Can I file the bounced check in small claims court if I cash the new check?

You cannot sue on the bounced check if you cash the new check, but you are entitled to request reimbursement for any bank charges you incurred as a result. You are also entitled to an itemization of the deductions from your rental deposit. If you don't get one, then you can go to small claims court.
