Legal Question in Landlord & Tenant Law in California

Bank Levy due to eviction

I was living in a rented house with my family and had to sign the first year's lease since I was over 18. My family was evicted three years later, around the same time I moved out on my own. After I moved my father went to court for the eviction and never told me that my name was on the paperwork. I never thought it would be since I never signed a new lease. I learned that I was involved in the eviction when my bank account was levied. The landlord filed court papers right before I moved so will I be held responsible for my family's debt?

Re: Bank Levy due to eviction

If you just learned, you might equitably ask the court to set aside the judgment against you, after you present very strong proof that you no longer were a tenant. Hope you have old utility bills for the place you moved to, an updated driver's license, etc. Because of the delay, you probably will face an uphill battle setting aside the judgment. Otherwise, the judgment is joint and several. It will be credited for any payment -- voluntary or involuntary -- made by any family member.
