Legal Question in Landlord & Tenant Law in California

Blocked Parking

I park my car in a single enclosed garage. My Garage happens to be nest to the fire lane, which is also used by residents for loading and un-loading only. It is a battle everyday trying to acess my garage because it is always blocked by maintence, other residents and even the Manager on site and her family members! This poses a big problem for coming and going! I have to have the menager ask people to move their cars, and of course hers as well! In my lease it states that no-one is to park there! I even spoke to the owner and shhe told me that she would speak to the manager. Nothing is being done! Is the reason to terminate my lease early?

Blocked and annoyed...

Re: Blocked Parking

I can appreciate your frustration.

Most landlords understand money.

Situations like this are not covered by most codes, but since this is in your lease, I would send landlord a certified letter that you will begin withholding a percentage of the rent (say 10%) for your troubles with the fire lane, until they have removed your obstacles.

However, I am not sure that a judge will consider this enough of a reason to break the lease.
