Legal Question in Landlord & Tenant Law in California

My boyfriend and the roommate are both on the lease. We want the roommate gone because he has sexually harassed me (put 11 pornographic ads scattered throughout my women's studies text book in my bedroom). I could not find anything in the lease that talked about roommate issues or sexual harassment. Is there anything I can legally do to get him out of the apt?

I think you have two options:

1. you might be able to go after him in a civil matter for the harassment, possibly get a restraining order of some kind.

2. you inform your landlord of the situation and possibly get the landlord to give him a "Notice to Perform or Quit" or "Notice to Quit" based on "Nuisance".

Neither of these are guaranteed. He is on the lease and has the same tenants' rights as you do. But his conduct might expose him as stated above. good luck.
