Possible breach of contract by landlord

My landlord served me with a 60 day notice to vacate on 5/6/03 as he wants to rent this unit to his brother. Yesterday, (5/12/03) I was glancing at my lease agreement and that the owner is responsible for paying sewage. The

owner has NEVER paid for the sewer service....as that has ALWAYS been included with my water bill. So, I have been paying for the sewer service.I did not realize that I

was not supposed to be paying for the sewer service until I

glanced at my lease/rental agreements yesterday.Am I entitled to be reimbursed for ALL of the monies that I have paid for the sewer service? If so, how do I go about

getting all of my money back, and can I charge the owner

interest on that amount as well? The amount I have paid is 1336.54 Also,is the owner in ''breach of contract'' for not paying for the sewer service... and if so, what remedy do I have for that?

It sounds like you may have a case. First write to the owner, point out what the lease says and give him copies of your sewage bills and ask him to pay you. If he doesn't, you can sue in small claims court.
