Legal Question in Landlord & Tenant Law in California
I need to know how to break my lease or how I can leave my apartment with little to no damages?
My roommate is psycho. In the past month, she has threatened me twice (for hours). Tonight she told me that she would "gladly go to jail for assaulting me."
She has called me every verbal hostile name you can call someone. She has thrown a chair in front of me in anger and has told me she "f**king hates" me.
She has admitted that her parents once considered putting her in a mental hospital. She has admitted to punching walls in anger.
I don't feel safe whenever she is here. I am afraid for my life and my property. I lock my door 24/7, and have lost sleep and a desire to eat because I am so depressed.
Staying is not an option. I don't feel safe.
I have to have some kind of rights.

Have you tried to speak to the landlord; point out that one of you has to leaveand that your right to peaceful enjoyment is being violated by his not removing the other roommate. If that does not very quickly work, call the police and see what they can do and if they can protect you from her trying to get even with you. They probably will not offer any real protection. You may have to have all of your stuff ready to move out before she finds out you contacted the landlord and/or the police.
