Legal Question in Landlord & Tenant Law in California

Breaking a lease

When we sign the 12m lease. Added to the contract states if we break the lease we will have to pay additional 200.00 per each month we lived here. Now that someone needs to break that lease they have been told ''That was the old contract and the new one is you pay for each additional month even if not living her'' Nobody with the old lease has known about this change in the contract or has received a addendum. Can they make you pay this amount or can you fight it because of the written contract with both signatures for the 200. per month. I think they are doing this to people that are more than likely not legal residency of USA.

Re: Breaking a lease

If you have not signed the "new" leycannot be held to its terms ... only the terms you did sign.

Re: Breaking a lease

It is not likely that you could be liable for terms that were not in the contract you signed. If this policy is being applied only to persons who are not legal U.S. residents, it might be illegal discrimination based on national origin.
