Legal Question in Landlord & Tenant Law in California

Please help!

Our building was to be auctioned off May 27, 2008, but it was postponed until June 27, 2008 by ''mutual agreement.'' Must I still pay the rent to the landlord who did not pay his mortgage for a year, or wait for the new owner or the bank to notify me? My rent will be due again July 1, 2008, if he is still entitled to collect rent.. Is he? Thank you.

You do have an obligation to pay the rent to the current owner until he or she is displaced from ownership through the foreclosure. I would wait until July 1, 2008 and see who owns it at that point. I would not make your payment early to the current owner, as he is likely to lose the building on June 27, 2008, assuming it goes forward.

Mr. Cohen is correct.

At the auction (6/27/08) ownership will change. Assuming no postponements, on July 1, you will owe the new owner.
