in california, can landlord charge a penalty fee to company leasing commercial property who doesn't return the premises in the same condition, but hasn't paid a security deposit?

Of course the landlord can. The lessee of any property, commercial or residential, is still liable for damages to the property or any other breach of the terms of the lease, regardless of whether they put up a deposit to pay for those damages or breach, or not.
