Legal Question in Landlord & Tenant Law in California

California medical marijuana and renters rights

I received a 3-day quit notice from my land loard. I have a prescription for it's use. Are there any legal citatons upholding my right to not be evicted? I have a hearing scheduled in 1 day.

Re: California medical marijuana and renters rights

If the three-day notice is for failure to pay rent, the answer is "no." If it's only for using medical marijuana, the answer is yes. You should get a declaration from your doctor signed under penalty of perjury that it's prescribed, and show that it's a medical necessity. In addition, what you do medically should be protected by your right to privacy. Good luck!

Mr. Cohen has answered your question.

Like Mr. Cohen, I assume the 2 day Notice is for your use of marijuana. Follow his advice!

If the 3 day notice is for non-payment of rent, then pay up or you will be evicted.
