Legal Question in Landlord & Tenant Law in California

California Residency

If my boyfriend moved in with me but he is physically abusive and I want him out, is there some residency law that says he can stay? He doesn't even pay rent.

Re: California Residency

If you want him out you have two options. Kick out order for abuse or eviction with notice. Contact me directly.

There is no such residency law, but you have every right to evict him.

If you are the only one on the lease, ask your landlord to give him a 3 day notice for being a "nuisance" and for committing a crime (physically abusive).

If he won't leave, the landlord needs to file an eviction, and will, almost certainly, ask you to pay the court costs.

If you need more, feel free to e-mail my office.

Good luck!
