California,we are landlords, tenant rent due on 1st called on the 3rd said they moved out because of domestic problems and we should probably change locks, they were supposed to give 30 day notice but did not. They left messages on our phone so we do have a record advising us.. Do we have to wait 30 days to take over our house or can we take over now? You are allowed to take over the house once it is clear the tenants have no intend of coming back to live there. You should document any damages not from ordinary wear and tear, including taking photos/video taping, and within 21 days of theri moving out send a detailed letter telling them what part of their security deposit you are keeping and why. If you have no forewarding address, check with the Post Offrice if they left one.
