Legal Question in Landlord & Tenant Law in California

My name is carlos alejo am a low -income. i would want to know have are the possibilities i have in the home that i rent for 14 year the owner just passed away and his daughter is the new owner of the property. theirs no rental agreement, one day she came and told us that everything was going to be the same than before and i tooked her word but know she wants to change it and is giving me papers out of the computer saying that to pay her the rest of the money. but she said that she wanted us to move out already and we said ok fine that we didnt want to have any problem that we were going to find somewere else to live. in that manner she keeps on bothering me with alot of papers saying that i have to go to court to pay some money of the rent but am telling her am moving out but she doesnt understand. she keeps on sending people to bring me papers about the manner.i have a daughter that has downsyndrome and i dont know what to do.she hasnt gave me the conviction letter saying to move. but i've been serching were to live but i cant find somewere fast so what should i do about this person her name is teresa lopez can u please help me i cant afford a good lawyer i dont have money am disable and my daughter also? can u help me please thank you.

While I can't give you specific legal advice in this forum, you might consider contacting some pro bono (free) or low-cost clinics who handle evictions for tenants in your situation. You might have to do a little research to find one in San Jose. I know there are a few in the Bay Area -- in Oakland, Berkeley, and San Francisco. You might even try the courthouse -- sometimes lawyers volunteer for eviction clinics.

Many people don't understand what the court papers say, so they ignore them. That's not a good idea because it could turn into a judgment not only for eviction but also for money. Bring the papers with you and any other documents you have regarding your tenancy, including rent receipts and copies of your rent checks. Good luck!
