Claiming Auction Proceeds

Long story short - I was evicted from my apartment in November 2006, my landlord hired ***Name Removed*** in order to auction off the contents of my unit. This auction was held on 01/03/2007. My question is this: How do I go about claiming the proceeds that remain after the landlord took the monies that were owed to him? ANY HELP WOULD BE MOST APPRECIATED. Thank you.

Contact the auctioneer and find out how much your items sold for, what his charges were and why, and then find out from the landlord. Point out to him that the law requires you to be paid the excess. If he will not, then you probably have to sue.

Mr. Shers' hit the nail on the head. Landlord is responsible to refund excess. Contact auctioneer, landlord, and get your money, or sue.
