Robert F. Cohen Law Office of Robert F. Cohen

Calling at midnight is harassment. The landlord must follow the law -- that is, to provide you with a three-day notice to pay or quit. If you don't pay within that three day period, the landlord could then go to court and file an unlawful detainer (eviction) lawsuit against you. You will have the opportunity to answer. If you don't file an answer with the court, or if you lose at trial, the landlord will obtain a judgment for possession and possibly back rent and other monetary damages. Within about a week, the sheriff will come to lock you out. Self help is prohibited, as are early morning phone calls.
