Legal Question in Landlord & Tenant Law in California

Construction and satelite dish relocation

The complex I live in (Northern California) is currently going through a construction phase in which they are covering the wood exterior with stucco/texture coat. When I moved in 4 years ago, there were no guidelines on satelite installation, moreover, there was a satelite already here. The management company just sent us a letter informing us that all our satelites were improperly installed and would have to be relocated to their specs, no mention as to whose expense. There will also be a 2 - 3 week interruption of service during the construction. My questions are these: 1. Should I have to pay for the relocation, and 2. Shouldn't I be reimbursed for the loss of service from the satelite?

Thank you,

Bill Giardino

Re: Construction and satelite dish relocation

Dear Bill:

Thanks for the :"thanks"...they are few and far between.

I am assuming you leave in a condo, and management is an "HOA". If so, you would have to look at the rules and regulations (CCR's) as to who pays for relocation and your being reimbursed. The answers are probably that you are responsible as to your questions.

If it not an HOA, you must look at the provisions of your lease, but you do have a good chance of recovering reimbursement, and you'll probably have to sue them in small claims court to collect.

Please feel free to e-mail my office, or call, if you need more help.
