Continue to Small Claims Court

An ex-tenant that I am taking to small claims court is making a last ditch effort to pay the bill (and thus keeping her credit history clean). Given that I have incurred more costs to go to court, can I deny her efforts and continue to small claims court?

If you are trying to run a business, you would be unwise to block her. You take the money and run! If you get a judgment, how sure are you that you will be able to collect on it? What will be the unreimbursed time, stress, and expenses you will have?

What do you think a judge will do when she states she is willing to pay the back rent but you want to get back your costs, which is a relatively small amount?

Mr. Shers is correct.

The judge is likely to send you two out into the hall to settle this, and unlikely to be sensitive to your miserly approach.
