Legal Question in Landlord & Tenant Law in California

copies of personal info

We live in a CA moble home park where we own the nome but rent the space. They now want copies of our car ttitle, registration and government ID's. I understand re the registration as they say they tow away unregistered cars, but not the other stuff, which seems none of their business. Is it legal for them to require the copies, and would they be liable if our personal info was stolen? I don't understand the purpose of the copies. We have been here about 18 years and I don't remember giving them copies before..

I am not that familiar with the law in this area, but I would think getting an government ID, such as social security number, probably is not permissible. Why do you not call their bluff by writing to the owner of the park, copy to the manager, saying that you spoke to an attorney who said that not only did he not know of any law that would support what they intend, aside from car registration information for the reason you state, but also there appears to be nothing of aid torunning their business to have the rest of the information. Since some is privileged, your giving them that information would be assisting them to commit an illegal act and might cause you some criminal responsibility. Ask for detailed reasons and an attorney's opinion as to why you should give up such information.

In deference to Attorney Shers, there are laws that cover some portions of what you have been asked to provide. Our firm does work specifically in manufactured and mobile home law, and the Mobile Home Residency Law (MRL - Cal. Civ. Code � 798, et seq.) does allow the park owner/management to request and obtain the vehicle titles. As you correctly suspected, it is to verify that they are legally registered and that registration is current. That is a permissible request, and you should comply. As for the mobilehome title, that's an entirely different story. The law governing this point changed many years ago, and it is no longer permissible for the park owner to demand copies of the registration. They can request it, and you can voluntarily provide it, but it you do not have to. Finally, as you have already been approved for tenancy, though the law does not specifically cover this point, I don't believe they can demand copies of government IDs. As Attorney Shers indicated, ask them to point to some specific requirement in your lease, or in the general law governing mobile home parks which allows them to demand that information. If they cannot provide it, then don't give it to them.
