Legal Question in Landlord & Tenant Law in California
I went to court today and got a restraining order against my roommate, as she was charged for battery against me. I served her with the papers today and she took somethings and left. She, however, left her cat behind.
We live in an apartment that does not permit cats, what so ever. The landlord is telling us if we don't remove the can she can evict us. My roommate is not here to remove her cat. The police officers who stood by for the serving of the restraining order told us we shouldn't mess with the cat.
Is it illegal for me to remove the cat by giving it away/placing it someplace else? I fear eviction if i don't, but i was also told that i should leave the cat in the apartment by the police officer.

Contact the roomate to pick up the cat. If the cat is not picked up; give it to animal control. The roomate cannot require you to take care of the cat and risk eviction.
