Legal Question in Landlord & Tenant Law in California

How to get my crazy roommate out of the apartment if she is on my lease

My roommate is crazy. She is on the lease. I have a current restraining order on her, and a police report that shows she has already volated the order. The manger of my apartments keeps telling me there is nothing he can do unless she is arrested, or serious hurts me. We have had one phyiscal fight already and she pulled a knife on me, but I was walking away so they say it is not a viable threat. I am scared to be in my apartment and can't stand to be with her. She won't leave and my manager won't help or says he can not help legally. What can I do? I can not break the lease because I won't have a place to live and I can't just leave because I am in college. This girl is out of control. She has threatened me and my other roommate many times. What can I legally do about this?

From the standpoint of landlord tenant law, you do have a problem. The manager, however, can do something, because you can evict one for being a "nuisance", as well as for criminal activity. You need to continue to ask the police for help with your TRO.

I would suggest hiring an attorney to write a strong letter to the manager, indicating the manager will be held liable if you are injured. Also, an attorney might be able to better talk to the police.

Also, are there not counseling services at college that would offer you some type of aid?

But, again, go after the manager.
